Terms of Service

These terms govern your booking and stay at Ivory Rook House. By making a reservation you agree to them, and you agree on behalf of everyone in your party.

Who we are

Ivory Rook House is owned and operated by Ivory Rook LLC, a Florida limited liability company. Throughout these terms, "we" and "us" mean Ivory Rook LLC; "you" means the person making the booking.

Booking and payment

A reservation is confirmed when you have paid in full or paid the required deposit and received written confirmation from us. Rates are quoted in US dollars. Applicable Florida and Miami-Dade transient rental taxes and any cleaning fee are added at checkout and shown before you pay.

Payment is processed through Stripe. Your card details go directly to Stripe and are never stored by us.

If a balance is due before arrival, it is charged automatically to the card on file on the date stated in your confirmation. A failed payment that is not resolved within 72 hours may result in cancellation of the reservation under the cancellation policy.

Who must be on the booking

The person booking must be at least 21 years old and must be one of the guests actually staying at the house. Bookings made on behalf of someone else, or by someone who does not intend to stay, may be cancelled without refund.

Occupancy

The house sleeps ten.

Daytime visitors are fine within reason. Anything that turns into an event is covered below.

Exceeding the stated occupancy without written approval is grounds for immediate termination of the stay with no refund.

Events and parties

Parties and events are not permitted on the property. An unapproved event is grounds for immediate termination of the stay with no refund.

House rules

Our House Rules form part of these terms. Please read them; they are short and none of them are surprising.

Damage and condition

You are responsible for the house and its contents during your stay, and for the conduct of everyone in your party. Normal wear is expected and never charged for. Damage, loss, or a level of mess that requires cleaning well beyond a standard turnover will be charged, including but not limited to damage caused by smoke or pets.

A hundred-year-old house

Ivory Rook House is historic, and part of its character is that it is not a new build. Occasionally something old behaves like something old. If a fixture or appliance fails during your stay we will repair or replace it as quickly as we reasonably can. A temporary failure of a non-essential amenity is not grounds for a refund, though we will always try to make it right.

Access and entry

We or our contractors may need to enter the property during your stay for maintenance, repairs, or safety. Except in an emergency, we will give you reasonable notice and work around you.

Cancellation

Cancellations are governed by our Cancellation Policy, which forms part of these terms.

If we have to cancel

In the rare case that we cannot honor a confirmed booking because the property is genuinely uninhabitable, we will refund you in full and help you find somewhere comparable. That refund is the limit of our liability in that situation.

Safety and Liability

You and your guests use the property, including any outdoor areas and pool, at your own risk. We are not liable for personal injury, illness, or loss or damage to personal property except where caused by our negligence and to the extent Florida law does not permit that liability to be limited.

The top floor balcony is enclosed with planters, and we have signage stating no one, under any circumstance, is allowed to bypass them to step onto the roof. The roof is not part of the rental property, and access to it is prohibited at all times, for any reason, by any guest or visitor. This is a direct violation of our Policy, and guests would be subject to immediate termination of the stay without refund, and are fully responsible for any injury, damage, or claim that results.

Children must be supervised at all times, in every part of the property, inside and outside. To the fullest extent permitted by law, our total liability in connection with your booking is limited to the total amount you paid for the stay.

Neither party is liable for failure to perform caused by events beyond reasonable control, including hurricanes and severe weather, mandatory evacuation orders, utility failures, government action, or civil emergency. Weather-related cancellations are addressed specifically in the Cancellation Policy.

Things outside anyone's control

Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.
